Welcome to EDUpeace. These Terms of Service ("Terms") govern your use of our platform and services. By accessing or using EDUpeace, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our platform.

1. Definitions

"Platform" refers to the EDUpeace website and any associated services.

"User" or "you" refers to any individual or entity using the platform.

"We" or "us" refers to EDUpeace.
2. Use of the Platform
2.1 Eligibility
To use EDUpeace, you must:

Be an MYP / IB teacher.

Have the legal capacity to enter into these Terms.
2.2 Account Registration
To access certain features of the platform, you must register for an account. You agree to:

Provide accurate and complete information during registration.

Keep your account information up-to-date.

Maintain the confidentiality of your login details.
2.3 Acceptable Use
You agree not to:

Use the platform for any unlawful purpose.

Upload or share any harmful or offensive content.

Attempt to gain unauthorised access to the platform or its systems.

Interfere with the operation of the platform or other users' use of the platform.
3. Services Provided
3.1 Comment Bank
Users can create, customise, and store comments in their Comment Bank. Users may also use and edit default comments provided by EDUpeace.
3.2 Upload Levels
Users can upload a CSV file containing student information such as names, genders, characteristics, criterion levels, and ATL achievements.
3.3 Comment Creator
Users can generate final report comments based on the information in the Comment Bank and Upload Levels. The generated comments are fully customisable.
4. Intellectual Property
4.1 Ownership
All content, features, and functionality on the platform are the exclusive property of EDUpeace or its licensors. This includes, but is not limited to, text, graphics, logos, and software.
4.2 User Content
You retain ownership of any content you upload or create on the platform. By uploading content, you grant EDUpeace a non-exclusive, royalty-free, worldwide licence to use, display, and distribute your content in connection with the platform.
5. Privacy
Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your personal information.
6. Limitation of Liability
To the fullest extent permitted by law, EDUpeace shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from:

Your use or inability to use the platform.

Any unauthorised access to or use of our servers and/or any personal information stored therein.

Any interruption or cessation of transmission to or from the platform.

Any bugs, viruses, trojan horses, or the like that may be transmitted to or through our platform by any third party.

Any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through the platform.
7. Indemnification
You agree to indemnify, defend, and hold harmless EDUpeace, its affiliates, and their respective officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees and costs, arising out of or in any way connected with:

Your access to or use of the platform.

Your violation of these Terms.

Your violation of any third-party rights, including without limitation any intellectual property, privacy, or proprietary right.
8. Termination
We may terminate or suspend your account and access to the platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.
Upon termination, your right to use the platform will immediately cease. If you wish to terminate your account, you may simply discontinue using the platform.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions. However, as EDUpeace is a global platform, we strive to comply with the data protection and privacy laws of the countries in which we operate. By using EDUpeace, you agree that any dispute arising out of or in connection with these Terms will be resolved in accordance with the laws of South Africa, except where local laws take precedence.
10. Changes to These Terms
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
